Medical Negligence Claims

If you believe you or a loved one has been injured as a result of the negligent actions of a doctor or other medical professional then you may be entitled to claim compensation.

Did a doctor make a mistake during surgery which has caused your or your loved one permanent physical ailments? Did a doctor prescribe you the wrong medication leaving you with severe long lasting side effects? Did surgery performed upon you or a loved one by a doctor leave you worse off than you were before surgery? If so you may be entitled to claim compensation.

To establish liability in negligence and to be deemed eligible to claim:

  1. It must be established that a duty of care was owed to you or your loved one by the doctor or other medical professional. This can usually be easily established if you were under the direct care or control of the doctor or medical professional when the concerned injuries occurred.
  2. It must then be demonstrated that due to the negligent actions of the doctor or medical professional, the duty of care owed was broken. This is usually demonstrated by satisfying the Court that the act of the doctor or medical professional did not conform to the standard of a reasonably competent doctor or medical professional in the same position as that doctor or medical professional.
  3. Finally, it must then be shown that the injury was sustained as a direct result of the duty owed and broken by the doctor or medical professional.
